Robert Treat Paine Papers, Volume 2
Sir! I was so embarrassed with Business for last Plimouth Court that I could not possibly get time to levy the Excn. Rumrill versus Millerd,1 and as I coud. not serve in the office of Dep. Sheriff any longer, handed the Excn. to Zachh. Paddok who engaged to proceed upon it immediately. Yours &c.,
The case of Sarah Rumriell, widow of Newport, R.I. v. John Millerd, yeoman of Wareham, concerned the default of a note for £21.10.9 plus interest. The July 1770 Court of Common Pleas for Plymouth Co. awarded the plaintiff damages and costs, which judgment was appealed by Millerd. The May 1771 session of the Superior Court at Plymouth Co. affirmed the lower court's decision, and the execution was issued on June 7, 1771. RTP represented the plaintiff (Plymouth Court Records, 8:341; Minute Book, Superior Court, Plymouth Co.).
